What is the difference between detention and arrest in Florida?



So if you've been detained by law enforcement, generally it doesn't mean that you're free to leave necessarily. It could be a situation where you're stopped for a traffic stop, perhaps the police officer smells what he believes is an odor of marijuana and he's detaining you while he's investigation whether or not you are in possession of that. If you've been arrested, you will be taken to jail and you will not be free to leave until you are bonded out.
